§1. General Provisions

2. These Terms & Conditions set out the rules governing the use of the online gallery, the placement of orders, the execution of sales, as well as the rights and obligations of the Seller and the Customer.

3. All prices displayed on the website are gross prices and are expressed in Polish zloty (PLN), unless indicated otherwise.
   
   

§2. Products

1. European Modern Art is an online gallery presenting and offering for sale curated original artworks originating from private collections and the contemporary art market.

2. Due to the unique nature of the artworks offered, product availability is limited to single pieces. In exceptional circumstances resulting from simultaneous sales channels, the Seller reserves the right to cancel an order and issue a refund.

3. A certificate of authenticity confirming the provenance and authenticity of the artwork is provided with each work.

4. Images of artworks are for illustrative purposes only. Due to individual screen settings, colours may differ slightly from their actual appearance.

5. Offered artworks may display individual characteristics resulting from the nature of the work, artistic technique, age of the artwork or creative process.

6. Information regarding artwork availability is published on the gallery website.
   
   

§3. Placing Orders

1. Orders may be placed through the website 24 hours a day.

2. Placing an order constitutes acceptance of these Terms & Conditions.

3. Upon placing an order, the Customer receives confirmation via e-mail.

4. The sales contract is concluded upon confirmation of order acceptance by the Seller.
   
   

§4. Payments

1. Electronic payments are processed through the payment provider Stripe Payments Europe Ltd. Available payment methods are presented during the checkout process.

2. Orders are processed upon receipt of payment.

3. The Seller reserves the right to cancel an order in the event of non-payment within 5 days.
   
   

§5. Delivery

1. Orders are fulfilled within Poland and selected European Union countries.

2. The order fulfilment period is between 1–4 business days.

3. Artworks are appropriately secured for transportation.

4. Delivery costs are indicated during the ordering process.
   
   

§6. Returns and Complaints

1. The Consumer has the right to withdraw from the contract within 14 days of receiving the product, in accordance with applicable legal provisions.

2. Returned products must be returned in an undamaged condition.

3. The cost of returning the product shall be borne by the Customer, unless the complaint is accepted.

4. Complaints may be submitted via e-mail to: europeanmodernart@gmail.com

5. Complaints shall be reviewed within 14 days.
   
   

§7. Copyright

1. All copyrights relating to the presented artworks remain vested in their respective authors or authorised rights holders.

2. The purchase of an artwork constitutes the acquisition of the physical work only and does not result in the transfer of copyright, reproduction rights, copying rights or rights to commercial use of the artwork’s image.

3. Any use, copying, reproduction or distribution of materials presented by European Modern Art without the consent of the copyright owners is prohibited.
   
   

§8. Personal Data

1. Customers’ personal data are processed in accordance with applicable legal provisions and the Privacy Policy.

2. Personal data are used exclusively for order fulfilment and communication with the Customer.
   
   

§9. Final Provisions

1. The Seller reserves the right to amend these Terms & Conditions; however, such amendments shall not affect orders placed prior to the effective date of the changes.

2. In matters not regulated herein, the provisions of Polish law shall apply.
